NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW OR REGULATIONS. The odds of being selected depend on the number of entries received. BY PARTICIPATING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT.
- SPONSOR: The Crystalyx® High-Performance Package Sweepstakes (the “Sweepstakes”) is sponsored by Ridley Block Operations, Inc., located at 111 West Cherry Street, Suite 500, Mankato, MN 56001, makers of Crystalyx® and subsidiary of Alltech, Inc., (“Sponsor”).
- AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of: a) the Official Rules, b) Sponsor’s Privacy Policy and Terms of Use (for online participants), and c) the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited by law. The collection and use of personal information for the Sweepstakes will be governed by Sponsor’s Privacy Policy and Terms of Use, located at https://www.crystalyx.com/privacy-policy-and-terms-of-use/.
- ELIGIBILITY REQUIREMENTS: Only individuals who are: (i) legal residents of the 50 United States and D.C., and (ii) at least 18 years old at the time of entry are eligible to enter and win. Employees, officers, and directors of Sponsor, its parent, subsidiary, affiliated or related companies, and all other entities associated with the creation, administration, promotion or fulfillment of the Sweepstakes, and each of their respective parent, subsidiary, affiliated and related companies (collectively, the “Sweepstakes Entities”), and each of their immediate family members and persons residing in the same household of such family members are not eligible to enter or win the Sweepstakes. All eligibility is subject to all federal, state, and local laws and regulations.
- ENTRY PERIOD: The “Sweepstakes Period” for entries begins September 15, 2021 at 12:00 P.M. Eastern Standard Time and ends December 15, 2021 at 11:59 P.M. Eastern Standard Time. The Sponsor’s computer will be the official time-keeping device. All entries must be received during the Sweepstakes Period to be eligible to win a prize.
- HOW TO ENTER: You may enter the Sweepstakes in the following way:
Free online entry: During the Sweepstakes Period, visit https://www.crystalyx.com/high-performance-giveaway/ and complete and submit the online entry form. Incorrect and incomplete entries are void.
There is a limit of one (1) entry, per valid email address, per eligible person, during the Sweepstakes Period, regardless of method of entry. If multiple entries are received, only the first entry will be accepted and additional entries will be disqualified. Multiple participants are not permitted to share the same email address. Any attempt by you to obtain more than one (1) entry by using multiple/different email addresses, identities, registrations or logins, or any other methods may void your entries and you may be disqualified from the Sweepstakes. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will void all entries by you. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential Winner may be required to show proof of being the authorized account holders. - USE OF PERSONAL INFORMATION: The collection of personal information for the Sweepstakes will be governed by Sponsor’s Privacy Policy, https://www.crystalyx.com/privacy-policy-and-terms-of-use/. By participating in the Sweepstakes, you hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy. When you enter at the website, you may be asked to consent to receive promotional e-mails and reminders for upcoming promotions and information about Sponsor. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. Except where prohibited, participation in the Sweepstakes constitutes your consent to Sponsor’s use of your name, likeness, entry, and state of residence for promotional purposes in any and all media, including the internet, without further payment, notification, permission or other consideration, except where prohibited by law.
- SELECTION AND NOTIFICATION OF POTENTIAL WINNER: The one (1) potential winner (the “Winner”) will be selected by random drawing from all eligible entrants on or about December 31, 2021. Odds of winning depend on the number of eligible entries received. The potential Winner may be required to fill out and sign an Affidavit of Eligibility and Release of Liability, except where prohibited by law, in order to accept the prize and confirm the entrant’s eligibility.
The Sponsor reserves the absolute right and discretion to select an alternate potential winner should the potential winner forfeit the prize, fail to claim the prize, or be disqualified as ineligible. Sponsor reserves the right to conduct a background check and conduct further diligence on any potential winner, and reserves the right in its sole discretion to disqualify any person or entity based on such background check or diligence if Sponsor determines in its sole discretion that awarding the prize to such potential winner might reflect negatively on Sponsor. Sponsor’s decisions on eligibility and awarding of prize are final and binding. Federal and state laws and regulations apply. Failure to comply with any requirement shall constitute forfeiture of the prize. - PRIZE: The Winner will receive the following: a DJI Mini 2 Drone, 1 ton of Crystalyx® product of Winner’s choosing, and a farm photoshoot. Approximate retail value (“ARV”) of the prize: $3,150.00. Details to be determined in Sponsor’s sole discretion. Sponsor may substitute a prize of equal or greater value in its sole discretion. All federal, state, and local taxes (including income taxes), fees and charges relating to the use and acceptance of the prize are the sole responsibility of the Winner. No substitution, transfer, or cash equivalent for the prize. Prize Winner will be issued a 1099 tax form for the actual value of prize.
- RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, each entrant and the Winner agrees to indemnify, release and hold harmless the Sponsor, and it related companies, subsidiaries, affiliates, administrator, advertising and promotional agencies, and all of their respective officers, directors, employees, contractors and agents (the “Released Parties”) from and against any liability, damage, losses, injury, or claim or cause of action arising out of the creation, administration, fulfillment, or participation in the Sweepstakes or receipt or use or misuse of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, telephone or network lines, or any interrupted or unavailable network server or other connections or communications; (c) any errors, omissions, interruptions or deletions of any kind due to electronic, human, mechanical, printing, production or technical errors or other causes; (d) lost, late, misdirected, unintelligible or undeliverable entries; (e) errors in the administration of the Sweepstakes or the processing of entries; (f) injury, death or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from such entrant’s participation in the Sweepstakes or receipt or use or misuse of the prize; or (g) any damage to any computer system resulting from access to or the download of information or materials connected with the Sweepstakes. Each entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. You further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. You acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.
- DISCLAIMERS OF WARRANTY: Sponsor and its affiliate and subsidiary companies do not make any warranties, express or implied, as to the condition, fitness or merchantability of the prize.
- GENERAL TERMS AND CONDITIONS: The Sponsor reserves the right to withdraw, amend or suspend this Sweepstakes (or to amend these Official Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Sweepstakes as contemplated by these Official Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure. The Sponsor reserves the right to cancel, amend or suspend this Sweepstakes, or to amend these Official Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.
The Sponsor reserves the right to adjust any of the dates, timeframes and/or other Sweepstakes mechanics stipulated in these Official Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Sweepstakes as contemplated in these Official Rules, or for any other reason.
In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Sweepstakes-related materials, the terms and conditions of these Official Rules shall prevail, govern and control to the fullest extent permitted by law. - DISPUTES: Except where prohibited, each entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a Commonwealth of Kentucky state or federal court. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor and/or Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Kentucky, without giving effect to any choice of law or conflict of law rules that would result in the application of the laws of any jurisdiction other than the Commonwealth of Kentucky.
- SEVERABILITY: The unenforceability of any clause of the Official Rules will not impact the enforceability of all other provisions of the Official Rules.
